What is Mediation?

Mediation falls under the umbrella term "Alternative Dispute Resolution". It offers an opportunity for "win-win" solutions, instead of the standard "win-lose" which emerges from litigation. The process is simpler and generally far less time-consuming; Mediation enables decisions to be generated and "owned" by the Principals in the conflict, thereby leading to lasting resolution. 

 

Away from distractions, in a non-threatening environment and in a spirit of willingness, “Principals” involved in a dispute or conflict may focus their full attention on the interests each have on a shared objective and reorient positions which led up to the problem.

The Principals are the leaders and decision makers in finding and reaching agreement:  The mediator’s role is to facilitate listening, understanding and cooperative brain-storming to find mutually acceptable solutions. Having participated in finding the resolution, Principals take ownership of the decision and it is thus more durable in the long term.

The confidentiality of the mediation process is protected by law. In this way the parties are safe to put forward their concerns to the mediator, free of any fear that information they reveal may be used against them.
